Introduction

AFD Software Ltd is dedicated to ensuring the security and protection of any personal data that you share with us, or that we collect from other sources. We are committed to adhering to the Data Protection Act 2018, the General Data Protection Regulation (“GDPR”), and other applicable data protection legislation. This privacy notice outlines the types of personal data we collect, the reasons for collecting it, how we use it, and the rights you have with respect to your personal data.

Where do we collect information about you from?

We may collect personal data from you in the following ways:

  • Directly from you, via telephone, through our website via enquiry or contact forms, or through our online ordering system.
  • From third-party AFD Partners, Resellers, or other business affiliates.
  • From publicly available sources, such as attendee lists from conferences and events where both parties are present.

Why do we collect information about you?

The primary purpose of collecting your personal data is to manage and fulfil our contractual relationship with you. Specifically, your data may be used for the following purposes:

  • To respond to and follow up on enquiries or requests for information.
  • To deliver products and services to you under the terms of a contract.
  • For ongoing administration and management of your account.
  • To send you our quarterly Postcode News, which includes updates on our programmes, data updates, new products and services, and relevant case studies.
  • To contact you via email, telephone, or post to inform you of any product issues, updates, or changes that may affect you.

How can you find out what data we hold about you?

You have the right to request access to the personal data we hold about you. To make a request, please submit a Subject Access Request Form  (“SAR”) to our Data Protection Officer, Duncan McLeod, at dpo@afd.co.uk.  Along with your SAR, you are required to provide identification to verify your identity. Acceptable identification includes:

  • An original or certified copy of a photographic identity document, such as a passport or driving licence; and
  • An original or certified copy of an address verification document, such as a birth certificate, utility bill, vehicle registration document, bank statement, or rent book, all of which must be dated within the last three months.

If the request is submitted electronically, we will provide the requested data in an electronic format unless otherwise requested.

We will respond to your request within one month of receiving it, unless the request is complex, in which case we may extend the response time by a further two months, and we will notify you if this is the case.

Will we share personal data about you?

As a general rule, we do not share your personal data with third parties. However, in the case of our Quarterly Postcode News, we may share certain personal data with trusted third parties, such as mailing houses, for the purpose of sending out the newsletter. This data may include:

  • Your name
  • Address
  • Job title (if applicable)
  • Telephone number
  • Fax number (if applicable)
  • Email address

We ensure that these third parties adhere to strict data protection protocols. You can opt out of receiving such mailings at any time by sending an “unsubscribe” request to postcode@afd.co.uk

Will We Contact You for Marketing Purposes?

We may send you our Quarterly Postcode News, which provides updates on new products, services, data changes, and case studies, to potential, active, and recently lapsed customers, unless you have opted out. We will send this newsletter by post, email, or both, depending on your preferences.

You can opt out of receiving this marketing communication at any time by emailing “unsubscribe” to postcode@afd.co.uk.

How can you request the deletion of your information?

If we have processed a Subject Access Request for you and you wish to have that information deleted, you may request the erasure of your personal data by emailing Duncan McLeod, Data Protection Officer, at dpo@afd.co.uk.

Requests for data deletion will be considered on a case-by-case basis, taking into account the following:

  • Whether we have met all contractual obligations.
  • Whether there are any outstanding fees or amounts owed.
  • Whether we are legally obligated to retain your data.

Please note that in some circumstances, we may be required by law to retain certain information.
